1. Acceptance of Terms
By accessing, browsing, or utilizing any services provided through the MKR Driving School website (mkr.ie), you (hereinafter referred to as “the User”) expressly agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement between the User and MKR Driving School (hereinafter referred to as “MKR”). MKR reserves the unilateral right to amend, modify, or update these Terms at its sole discretion, without prior notice. Continued use of the website or services after modifications signifies the User’s acceptance of the updated Terms.
2. Use of Website
The MKR website and its contents are made available to the User strictly for personal, non-commercial use. The User acknowledges that all information, materials, and resources provided by MKR are for informational purposes only. MKR reserves the right to alter, modify, suspend, or terminate access to the website or any part thereof without notice.
By submitting any information or materials to MKR, the User grants MKR a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, distribute, display, modify, and transmit such information or materials. The User warrants that no submitted materials will infringe upon the rights of any third party or contain any defamatory, libelous, offensive, or otherwise unlawful content.
3. Intellectual Property Rights
All trademarks, logos, service marks, and proprietary content displayed on the MKR website are the exclusive property of MKR unless otherwise indicated. Unauthorized use, reproduction, or distribution of any content from the website without prior written consent from MKR is strictly prohibited and may result in legal action.
4. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of Ireland. Any disputes arising in connection with these Terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Ireland. The User agrees to submit to the personal and exclusive jurisdiction of such courts.
5. Lesson Cancellation Policy
The User is required to provide a minimum of 48 hours’ notice in the event of a cancellation or rescheduling of any scheduled lesson. Failure to provide such notice will result in a forfeiture of 100% of the lesson fee. In cases of pre-paid lessons, failure to attend or adhere to the cancellation policy will result in the forfeiture of the pre-paid amount. Transfer or sale of lessons to third parties is strictly prohibited without the express written consent of MKR.
6. Insurance and Liability
MKR ensures that all instructors carry the appropriate motor insurance required by law to cover learner drivers. In the event of an accident or collision during a lesson, the instructor will take over control of the vehicle in compliance with insurance and legal obligations. The User acknowledges that the instructor retains full discretion over the vehicle during lessons and that all driving instruction is undertaken at the User’s own risk.
7. Price Modifications
MKR reserves the right to adjust, amend, or alter the prices of lessons, services, or products at any time, without prior notification to the User. Such changes shall take effect for any bookings or purchases made after the effective date of the adjustment.
8. Payment Terms
Payments for lessons are required in advance and must be made directly to the instructor conducting the lesson. MKR does not store or handle credit card details. Payments may be made through online banking, Revolut, or any other method agreed upon with the instructor. MKR disclaims any responsibility for payment disputes between the User and the instructor.
9. Refund Policy
Should the User need to cancel their lessons and has provided at least 48 hours’ notice prior to the first lesson, they will be entitled to a refund of the pre-paid amount, subject to a 20% administrative fee (with a minimum charge of €20). Refund requests must be made within a three-year period from the original payment date. Gift vouchers are strictly non-refundable and valid for one year from the date of purchase.
10. Limitation of Liability
MKR and its instructors disclaim any and all liability for direct, indirect, incidental, consequential, or punitive damages arising from the use of the website, services, or lessons provided. The User acknowledges that MKR is not a party to any contract between the User and the instructor, and as such, MKR bears no responsibility for any claims, losses, or damages arising from the provision of driving instruction. Nothing in these Terms affects the User’s statutory consumer rights.
11. Tyre and Wheel Damage
The User shall be held liable for any damage, puncture, or burst to the tyres or wheels of the vehicle caused by the User’s negligence or error during a lesson. The cost of any repairs or replacements will be borne solely by the User.
12. Complaints Procedure
In the event the User wishes to lodge a complaint regarding their driving tuition, they must first attempt to resolve the matter directly with the instructor. If resolution cannot be achieved, the User may escalate the issue by contacting MKR via email at info@mkr.ie. MKR aims to respond to complaints within two (2) business days.
13. Disclaimers
The MKR website and its contents are provided “as is,” without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. MKR makes no representations or guarantees regarding the uninterrupted or error-free operation of the website or the availability of services. The User assumes all risk associated with the use of the website and services.
14. Miscellaneous
These Terms and Conditions constitute the entire agreement between the User and MKR regarding the use of the website and services, superseding any prior agreements or understandings, written or oral. Should any provision of these Terms be deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
